1. Agreement and publisher
These Terms of Use (“Terms”) are an agreement between you and Things (“Things,” “we,” “us,” or “our”), the publisher of Audio Finder. By accessing audiofinder.app or using Audio Finder, you agree to these Terms. If you do not agree, do not use the website or product.
2. What Audio Finder provides
Audio Finder is a macOS menu-bar utility that identifies apps using audio output and can bring a selected source forward. Its optional Chrome and Brave connector can add the title of a non-incognito browser tab that the browser marks as audible. Features, system requirements, and availability may change as the product evolves.
3. Apple App Store license
When you obtain Audio Finder through Apple’s Mac App Store, Apple’s Standard End User License Agreement (“Apple Standard EULA”) is the license agreement for the app. These Terms do not replace the Apple Standard EULA or conflict with the Apple Media Services Usage Rules; if there is a conflict, the Apple Standard EULA and applicable Usage Rules control for the App Store copy.
- The app license is between you and Things, not Apple. Things is solely responsible for Audio Finder and its content.
- The license is non-transferable and permits use on Apple-branded products you own or control, subject to Apple’s Usage Rules and permitted Family Sharing or volume-purchase use.
- Things, not Apple, is responsible for maintenance, support, product claims, legal compliance, and intellectual-property claims concerning Audio Finder.
- To the maximum extent permitted by law, Apple has no warranty obligation for Audio Finder beyond any refund remedy described in the Apple Standard EULA.
- You represent that you are not located in a country or region subject to a U.S. Government embargo or designated as supporting terrorism and are not on a U.S. Government prohibited- or restricted-party list.
- You must comply with applicable third-party terms when using the app, including Apple’s, Google Chrome’s, and Brave’s terms where applicable.
- Apple and its subsidiaries are third-party beneficiaries of the Apple Standard EULA and may enforce it as provided there.
4. Browser connector license
Subject to these Terms, Things grants you a limited, personal, revocable, non-exclusive, non-transferable license to install and use the Audio Finder Browser Connector with the Audio Finder Mac app. The connector requires your explicit opt-in and may be disabled or uninstalled at any time.
5. Acceptable use
You may not:
- use Audio Finder in violation of law or another person’s rights;
- circumvent security, access controls, store rules, or technical restrictions;
- interfere with, damage, or overload the website, app, connector, or another system;
- misrepresent Audio Finder, remove proprietary notices, or use our branding in a way that suggests endorsement; or
- reverse engineer or redistribute the product except where applicable law or an applicable open-source license expressly permits it.
6. Privacy
Our Privacy Policy explains how Audio Finder handles information. It is incorporated into these Terms by reference. The core app does not record audio, and the optional connector communicates audible-tab details only to the Mac app on the same device.
7. Third-party platforms
Audio Finder interoperates with operating systems, browsers, and stores provided by third parties. Apple, Google, and Brave do not sponsor or endorse Audio Finder. Their services and stores are governed by their own terms, may change independently, and may affect product availability or functionality.
8. Ownership and feedback
Audio Finder, its website, branding, and original content are owned by Things or its licensors and are protected by applicable intellectual-property laws. If you voluntarily send feedback, you grant us permission to use it to improve Audio Finder without restriction or compensation, provided we do not identify you publicly without permission.
9. Updates, availability, and termination
We may release updates, change features, or discontinue availability. We may suspend access if reasonably necessary to address misuse, security, legal requirements, or platform rules. You may stop using Audio Finder at any time by uninstalling it. Sections that by their nature should survive—such as ownership, disclaimers, liability limits, and dispute terms—will survive termination.
10. Disclaimers
To the fullest extent permitted by law, the website and product are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise uninterrupted operation or that every audio source will be identifiable in every system configuration. Nothing in these Terms limits rights or warranties that cannot lawfully be excluded.
11. Limitation of liability
To the fullest extent permitted by law, Things will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from the website or product. Things’ total liability for claims relating to Audio Finder will not exceed the greater of the amount you paid for Audio Finder in the twelve months before the claim or US $50. These limits do not apply where prohibited by law.
12. Changes and severability
We may update these Terms to reflect product, legal, or operational changes. The updated version will be posted here with a new effective date. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver.
